These Terms of Service ("Terms") govern your access to and use of the Logmonitor.io website, services, and applications (collectively, the "Service"), operated by Panara Studio LLC ("we," "us," or "our").

Please read these Terms carefully. By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

1. The Service

Logmonitor provides a service to capture, stream, and display console logs and other debugging data ("User Logs") from your applications ("Your Applications") for the purpose of remote debugging and monitoring.

2. Accounts

• Eligibility: You must be at least 18 years old to use the Service.
• Account Security: You are responsible for safeguarding your account credentials. You agree to notify us immediately of any unauthorized use of your account. You are responsible for all activities that occur under your account, whether or not you know about them.

3. User Data and Responsibilities

• You Own Your Data: You retain all rights and ownership of Your Applications and the User Logs you submit to the Service. We do not claim any ownership over your data.
• Your Responsibility as Data Controller: You are the "Data Controller" for the User Logs you send to Logmonitor. This means you are solely responsible for the content and legality of the data you transmit.
• Prohibition of Sensitive Data: You agree not to use the Service to collect, transmit, or process any sensitive personal information. This includes, but is not limited to, government-issued identification numbers, financial account numbers, credit or debit card numbers, personal health information, or any other information that is subject to specific data protection laws like HIPAA or PCI-DSS.
• User Privacy: You must ensure that your use of the Service is compliant with all applicable privacy laws and that you have obtained the necessary consents from your end-users to collect and transmit their data to Logmonitor, as described in your own privacy policy.

4. Fees, Payments, and Plans

• Plans: The Service is available under different plans, including a one-time payment Lifetime Deal and recurring subscription plans. The features and limits of each plan are described on our Pricing page.
• Payment: You agree to pay all fees associated with your chosen plan. All payments are processed through our third-party payment processor, Stripe. By using the Service and agreeing to these Terms, you also agree to be bound by Stripe's Services Agreement.
• Billing: For subscription plans, you will be billed in advance on a recurring, periodic basis (e.g., monthly). For more details, please see our Payment & Refund Policy.

5. Acceptable Use

You agree not to misuse the Service. For example, you must not:

• Use the Service for any illegal purpose or in violation of any laws.
• Attempt to probe, scan, or test the vulnerability of the Service or any related system or network.
• Interfere with or disrupt the access of any user, host, or network.
• Impose an unreasonable load on our systems.

6. Termination

• By You: You can stop using the Service and cancel your account at any time through your account settings.
• By Us: We may suspend or terminate your access to the Service at any time, with or without cause or notice, for any reason, including for a violation of these Terms or non-payment of fees.

7. Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED "AS IS," WITHOUT ANY WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL PANARA STUDIO LLC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS PRIOR TO THE CLAIM, OR ONE HUNDRED DOLLARS ($100).

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, USA, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the state and federal courts located within Delaware for the resolution of any lawsuit or court proceeding permitted under these Terms.

9. Changes to Terms

We reserve the right to modify these Terms at any time. If we make changes that are material, we will provide you with reasonable notice prior to the changes taking effect, such as by emailing you or posting a notice on our website. Your continued use of the Service after the changes have become effective constitutes your acceptance of the new Terms.
